ASSUMPTION OF RISKS AND LIABILITY WAIVER FORM (FOR MINORS) Company.

This Assumption of Risks and Liability Waiver Form ("Release") is entered into by and between Sip and Cake Create Nashville LLC, with its registered office at 3706 Clarksville Pike, Nashville, TN 37218; Email: sipandcakecreatenashville@gmail.com ("Sip and Cake Create Nashville" or “Company”) and the undersigned parent or legal guardian ("I" or "Parent/Guardian") of the minor participant named below ("Minor").

By signing this Release, I confirm that I am the parent or legal guardian of the Minor and that I am granting permission for them to voluntarily take part in one or more of Sip and Cake Create Nashville’s in-person cake decorating events, workshops, or classes. I understand that these activities are recreational but may involve certain risks. This document explains those risks, my responsibilities, and the legal rights I am giving up on behalf of the Minor.

Sip and Cake Create Nashville aims to provide a safe, welcoming, and enjoyable environment for all participants, including children. This Release is intended to help make sure that I understand what’s involved, what is expected of the Minor, and how responsibility is shared. This Release is intended to apply to both me and the Minor and to waive and release, to the maximum extent allowed by law, any claims that either of us may have against the Company. I will review this document in full, ask any questions I may have before signing, and confirm that I am signing it willingly and with full understanding of its terms.

1. Eligibility and Voluntary Participation:
I confirm that I am the parent or legal guardian of the Minor named in this Release, and that I have the legal authority to sign on their behalf. I understand that participation in Sip and Cake Create Nashville’s events is completely voluntary. I am choosing to allow the Minor to take part in one or more of these events of my own free will, and I understand that the Minor may stop participating at any time if they feel uncomfortable or unwilling to continue.

2. Acknowledgement and Assumption of Risks:
I understand that by allowing the Minor to participate in cake decorating events hosted by Sip and Cake Create Nashville, there are certain risks involved. These may include, but are not limited to, minor injuries such as cuts or scrapes from decorating tools, slips or trips on materials or surfaces, muscle strain from standing or movement, or accidental contact with furniture, tools, or other participants. I also understand that ingredients or materials used at the event may trigger allergic reactions or sensitivities, even if reasonable precautions are taken. The Minor may experience emotional discomfort, frustration, or difficulty during structured group activities, especially in a busy or unfamiliar setting. While staff will be present to promote a safe and positive environment, I acknowledge that oneon-one supervision is not guaranteed. I understand that these risks are inherent to the nature of the activity and cannot be completely eliminated, and I voluntarily accept full responsibility for all such risks, known or unknown, on behalf of the Minor

3. Minor Participant Responsibilities:
I understand that the Minor is expected to behave respectfully, follow all safety instructions, and listen to the guidance of Sip and Cake Create Nashville staff during the event. I will explain to the Minor the importance of using tools and materials safely, cooperating with others, and following all posted signs and staff directions. I acknowledge that if the Minor behaves in a disruptive, unsafe, or inappropriate manner, they may be asked to stop participating or to leave the event, and I understand that no refund will be provided in such cases.

4. Supervision and Guardian Responsibility:
I understand that while Sip and Cake Create Nashville staff will be present to help create a safe and enjoyable environment, I remain fully responsible for supervising the Minor during the event. I agree to stay on-site or nearby and be available if needed. I acknowledge that the Company does not provide personal or one-onone supervision, and that the Minor's safety and conduct ultimately remain my responsibility throughout their participation.

5. Restrictions:
I agree that the Minor will not bring any outside food, tools, or materials to the event unless I have received prior written approval from Sip and Cake Create Nashville. I understand that certain areas and equipment may be off-limits for safety reasons, and I will ensure the Minor respects these boundaries. I acknowledge that if the Minor engages in any behavior that is unsafe, disruptive, or violates event guidelines, the Company may remove them from the event, and no refund will be issued.

6. Allergies and Health Conditions:
I understand that ingredients and materials used during events may include or come into contact with common allergens such as dairy, eggs, wheat, soy, or nuts. I confirm that I am fully responsible for managing the Minor’s allergies or health conditions. I acknowledge that Sip and Cake Create Nashville does not collect allergy information, does not provide special accommodations, and is not responsible for any allergic reactions or healthrelated incidents that may occur. I am allowing the Minor to participate at their own risk.

7. COVID-19 and Illness Policy:
I understand that participation in public events carries a risk of exposure to illnesses, including COVID-19, flu, and other contagious conditions. I agree that I will not bring the Minor to any event if they are feeling unwell, have a fever, or have tested positive for a contagious illness within the recommended isolation period. I accept full responsibility for the Minor’s health and agree that Sip and Cake Create Nashville is not liable for any illness the Minor may contract before, during, or after the event.

8. Personal Belongings:
I understand that the Minor’s personal items, including clothing, phones, bags, or valuables, are my responsibility. Sip and Cake Create Nashville is not liable for any lost, stolen, or damaged belongings brought to the event by the Minor.

9. Emergency Medical Treatment Consent:
In the event of an accident or medical emergency involving the Minor during the event, I authorize Sip and Cake Create Nashville to seek emergency medical care as needed. I understand that reasonable efforts will be made to contact me as soon as possible. I accept full responsibility for any medical expenses that may arise and release the Company from any liability related to the medical assistance provided.

10. Media Release:
I understand that photos or videos may be taken during the event and may include the Minor’s image, voice, or likeness. By allowing the Minor to attend, I give Sip and Cake Create Nashville permission to use, reproduce, publish, or share these recordings for promotional, advertising, or commercial purposes in any format, including social media, print, or online platforms. This permission is without compensation. I also allow such materials to be edited or combined with other content. If I do not wish for the Minor to be photographed or recorded, I will inform the staff in writing before the event.

11. Limitation of Liability, Waiver of Claims, and Release:
I understand and agree that the Minor’s participation in any event hosted by Sip and Cake Create Nashville is entirely voluntary and at our own risk. To the fullest extent permitted by law, I and the minor, waive, release, and forever discharge Sip and Cake Create Nashville LLC, along with its owners, staff, contractors, representatives, affiliates, successors, and assigns (“Released Parties”), from any and all claims, demands, damages, losses, liabilities, costs, or causes of action, known or unknown, that may arise from or relate to the Minor’s participation in any event, activity, or use of the premises or equipment. This includes, without limitation, claims for personal injury, property damage, emotional distress, illness, or economic loss, even if caused by the ordinary negligence of the Company or its representatives. This waiver applies to any claims that I or the Minor may have now or in the future. I agree that this release is intended to be as broad and inclusive as allowed by law, and that if any part is found unenforceable, the remainder will remain valid and in effect. I understand that me and the Minor are giving up substantial legal rights by signing this document.

 

12. Indemnification:
I agree to fully indemnify, defend, and hold harmless the Released Parties from and against any claims, losses, liabilities, damages, costs, or expenses (including reasonable legal fees) arising out of or related to the Minor’s participation in the event. This includes any claims made by or on behalf of the Minor, other participants, third parties, or authorities resulting from the Minor’s actions, use of equipment, or failure to follow safety rules or staff instructions. This indemnification applies even if the Company is also alleged to be partly at fault, unless prohibited by law.

13. Entire Agreement and Modification:
This Release represents the complete understanding between me and Sip and Cake Create Nashville regarding the Minor’s participation in the event. It replaces any prior agreements or discussions, whether written or verbal. No changes to this Release will be valid unless made in writing and signed by both me and an authorized representative of the Company.

 

14. Severability:
If any part of this Waiver is found to be invalid, unenforceable, or illegal by a court of law, the rest of the Waiver will remain valid and continue in full force and effect. The invalid or unenforceable portion shall be interpreted or modified to the minimum extent necessary to make it valid while preserving the original intent of this Waiver.

15. Right to Refuse Service:
I understand that Sip and Cake Create Nashville reserves the right to refuse service or remove the Minor from an event at any time if their behavior is unsafe, disruptive, disrespectful, or violates any event guidelines. This decision may be made at the sole discretion of staff. I acknowledge that if the Minor is asked to leave under these circumstances, no refund or compensation will be provided.

 

16. Governing Law and Exclusive Jurisdiction:
This Release is governed by the laws of the State of Tennessee, without regard to its conflict of law principles. Any dispute arising from or related to this Release or the Minor’s participation in the event shall be resolved exclusively in a state or federal court located in or serving Davidson County, Tennessee. I consent to the personal jurisdiction of those courts for any such legal matters.

 

17. Binding:
This Release is binding upon me, the Minor, and our respective heirs, executors, administrators, legal representatives, and any person who may assert a claim on the Minor’s behalf. It also benefits Sip and Cake Create Nashville and its successors and assigns. I further agree that this Release is intended to bind both myself and the Minor to the fullest extent allowed by law.

18. Acknowledgement by Parent / Legal Guardian:
By signing below, I confirm that I am the parent or legal guardian of the Minor named in this Release and that I have full legal authority to make decisions and grant permissions on their behalf. I have carefully read and fully understood this entire Waiver Form, including the risks involved, the responsibilities I am accepting, and the legal rights I am waiving both for myself and for the Minor. I have had the opportunity to ask questions, and I have been advised that I may seek independent legal advice before signing. I am signing this Release freely, without any pressure or promise from Sip and Cake Create Nashville or its staff, and I agree that both I and the Minor will be legally bound by its terms to the fullest extent allowed by law.

This Assumption of Risks and Liability Waiver Form ("Release") is entered into by and between Sip and Cake Create Nashville LLC, with its registered office at 3706 Clarksville Pike, Nashville, TN 37218; Email: sipandcakecreatenashville@gmail.com ("Sip and Cake Create Nashville" or “Company”) and the undersigned participant ("Participant").

I am voluntarily choosing to take part in one or more of Sip and Cake Create Nashville’s in-person cake decorating events, workshops, or classes. This document explains the risks involved in participating, including possible injuries, allergic reactions, alcohol-related risks, or other situations that may occur during the event. It also explains my responsibilities. Sip and Cake Create Nashville LLC wants every guest to have a safe and enjoyable experience. This Release helps make sure that I understand the expectations. I will take the time to read through each section carefully and ask any questions I have before signing.

1. Eligibility and Voluntary Participation:
I confirm that I am at least 18 years of age and legally able to enter into this agreement. I understand that participating in cake decorating events with Sip and Cake Create Nashville is entirely voluntary. I have not been forced or required to attend and I am choosing to participate of my own free will, knowing that I can leave at any time if I feel uncomfortable or unwilling to continue.

2. Acknowledgement and Assumption of Risks:
I understand that participating in Sip and Cake Create Nashville’s cake decorating events involves certain physical and activity-related risks. These may include, but are not limited to, minor cuts or scrapes from tools like cake scrapers and spreaders, muscle strain or fatigue from standing, slipping or tripping on materials or spills, and accidental contact with sharp or pointed decorating items. I also acknowledge that there may be risks related to my own or others’ behavior, including accidental bumps or spills, as well as injuries resulting from the misuse of equipment, furniture, or décor. I accept that my personal items or clothing may be damaged during participation, and that unexpected stress or discomfort may arise from group-based or guided activities. I understand that participation may also aggravate any pre-existing physical condition I have. I acknowledge that these risks are inherent in this type of activity, that they cannot be entirely eliminated even with care, and I accept full responsibility for all such risks, whether expected or unexpected.

3. Participant Responsibilities:
I agree to act respectfully and follow all safety instructions, signs, and staff guidance during the event. I will use all tools and materials properly and report any unsafe conditions to staff. I understand that disruptive, unsafe, or inappropriate behavior may result in being asked to leave without a refund.

4. Restrictions:
I will not bring outside food, tools, or materials without prior written approval. I will avoid tampering with equipment, entering restricted areas, or being under the influence of anything that affects safety or the experience of others. I understand that breaking these rules may result in immediate removal without a refund.

5. Allergies and Health Conditions:
I understand that ingredients used at Sip and Cake Create Nashville events may include or come into contact with allergens like dairy, eggs, wheat, soy, or nuts. I am fully responsible for managing my own allergies or health conditions and agree that participation is at my own risk. I acknowledge that the Company does not collect allergy information and is not liable for any allergic reactions or health-related issues that may occur.

6. Alcohol Consumption Disclaimer:
I understand that Sip and Cake Create Nashville does not serve or monitor alcohol at its events. If I choose to bring and consume alcohol, I confirm that I am at least 21 years of age, which is the legal drinking age in the State of Tennessee. I take full responsibility for ensuring that no one under the age of 21 is allowed to access or consume any alcohol I bring. I accept all risks and consequences related to alcohol use, including any impact on my behavior or safety. I agree to comply with all posted signs, including those marking alcohol-free areas, and I acknowledge that the Company is not responsible for any incidents, injuries, or damages related to the possession or consumption of alcohol by me or any other guest.

7. COVID-19 and Illness Policy:
I understand that participating in public events carries the risk of exposure to illnesses, including COVID-19, flu, and other contagious conditions. I confirm that I will not attend if I am feeling unwell, have a fever, or have tested positive for any contagious illness within the recommended isolation period. I accept full responsibility for my health and agree that Sip and Cake Create Nashville is not liable for any illness I may contract before, during, or after the event.

8. Personal Belongings:
I understand that I am fully responsible for my personal items during the event. Sip and Cake Create Nashville is not liable for any lost, stolen, or damaged belongings, including phones, bags, clothing, or valuables brought into the venue.

9. Emergency Medical Treatment Consent:
In the event of an accident or medical emergency during the event, I authorize Sip and Cake Create Nashville to seek emergency medical care on my behalf if I am unable to do so. I understand that I am responsible for any medical expenses incurred and release the Company from any liability related to the medical assistance provided.

10. Media Release:
I understand that photos or videos may be taken during the event and may include my image, voice, or likeness. By attending, I give Sip and Cake Create Nashville permission to use, reproduce, publish, or share these recordings for promotional, advertising, or commercial purposes in any format, including social media, print, or online platforms. This permission is granted worldwide, without limitation, and without compensation. I also allow such materials to be edited, altered, or combined with other content. I understand that these materials may be shared with third-party vendors or partners working with the Company. If I do not wish to be photographed or recorded, I will notify the staff in writing before the event begins.

11. Limitation of Liability, Waiver of Claims, and Release:
I understand and agree that my participation in any event hosted by Sip and Cake Create Nashville is entirely voluntary and at my own risk. To the fullest extent permitted by applicable law, I hereby waive, release, and forever discharge Sip and Cake Create Nashville LLC, along with its owners, staff, contractors, representatives, affiliates, successors, and assigns (“Released Parties”), from any and all claims, demands, damages, losses, liabilities, costs, or causes of action, whether known or unknown, that may arise from or relate to my participation in any event, activity, or use of the premises or equipment. This includes, without limitation, any claims for personal injury, property damage, emotional distress, illness, death, or economic loss, even if caused by the ordinary negligence of the Company or anyone acting on its behalf. I agree that this release is intended to be as broad and inclusive as allowed under applicable law, and that if any part of it is found invalid, the rest shall remain fully enforceable. I understand that I am giving up substantial legal rights by signing this document and I do so knowingly and voluntarily.

12. Indemnification:
I agree to fully indemnify, defend, and hold harmless the Released Parties from and against any claims, liabilities, losses, damages, costs, or expenses (including reasonable legal fees) that arise out of or relate to my actions, conduct, or participation in any event. This includes, but is not limited to, any claims brought by other participants, third parties, or authorities as a result of something I did or failed to do, any misuse of equipment or materials, or any violation of this Release. This obligation applies even if the Company is also alleged to be partly at fault, except where the law does not allow such indemnification.

13. Entire Agreement and Modification:
This Release reflects the entire understanding between me and Sip and Cake Create Nashville regarding my participation in the event. It replaces any previous agreements, discussions, or understandings, whether spoken or written. No changes to this Release will be valid unless made in writing and signed by both me and an authorized representative of Sip and Cake Create Nashville

14. Severability:
If any part of this Waiver is found to be invalid, unenforceable, or illegal by a court of law, the rest of the Waiver will remain valid and continue in full force and effect. The invalid or unenforceable portion shall be interpreted or modified to the minimum extent necessary to make it valid while preserving the original intent of this Waiver

15. Right to Refuse Service:
I understand that Sip and Cake Create Nashville reserves the right to refuse service or remove any participant from an event at any time if my behavior is disruptive, unsafe, disrespectful, or violates the guidelines set by the Company. This decision may be made at the sole discretion of staff, and I agree that I will not be entitled to any refund or compensation if I am asked to leave under these circumstances.

This Waiver is binding on me, my heirs, executors, administrators, legal representatives, and anyone else who may claim on my behalf. It also extends to and benefits the Sip and Cake Create Nashville, including their successors and assigns.

18. Acknowledgement by Participant:
By signing below, I confirm that I have read and understood this Assumption of Risks and Liability Waiver Form in full. I have had the opportunity to ask questions about any part of this document, and all of my questions, if any, have been answered to my satisfaction. I understand the nature of the activities I will be participating in, the risks involved, and the legal rights I am giving up. I acknowledge that I have been advised that I may seek independent legal advice before signing, and I am signing this Release voluntarily, without any pressure, promise, or guarantee from Sip and Cake Create Nashville or its staff. I agree to be legally bound by the terms of this Release.
